1. Agreement

These Terms of Use ("Terms") govern your access to and use of the Jamis Companies website (the "Site"), operated by Jamis Companies ("Jamis," "we," "us"), 2140 Arapahoe Street, Denver, CO 80205. By using the Site you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.

2. Information only — no offer

Property listings, market data, Market Pulse figures and articles are provided for general information only. They are not an offer to sell or lease, an appraisal, or legal, tax, financial or investment advice. Asking prices, sizes and availability may change or contain errors and should be independently verified. No brokerage relationship is created by using the Site; any representation requires a separate written agreement under Colorado real estate law.

3. Third-party listings

Some listings are supplied by The Commercial Co-Op and its members. Jamis does not control, verify or guarantee third-party listings, and they remain the property of their respective owners.

4. Acceptable use

You agree not to: (a) scrape, crawl, harvest, copy or index Site content or listing data by automated means, including bots, spiders or scripts, except general-purpose search engines complying with our robots rules; (b) build a database or competing service from Site content; (c) interfere with, overload or attempt to gain unauthorized access to the Site, its servers or accounts; (d) submit false, unlawful or spam inquiries; (e) use the Site in violation of any law, including fair-housing and anti-discrimination laws.

5. Intellectual property

The Site, its design, text, photographs, maps, logos and the JAMIS name are owned by Jamis or its licensors and are protected by U.S. copyright and trademark laws. You may view and print pages for personal, non-commercial evaluation of real estate only.

6. Your submissions

When you send an inquiry you confirm the information is accurate and that you may share it. We handle it as described in our Privacy Policy.

7. Third-party services and credits

The Site links to and uses third-party services. Maps use OpenFreeMap, © OpenMapTiles and data © OpenStreetMap contributors. We are not responsible for third-party sites or content.

8. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JAMIS AND ITS OWNERS, BROKERS AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

10. Indemnity

You agree to indemnify and hold Jamis harmless from claims arising from your misuse of the Site or violation of these Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in the City and County of Denver, Colorado, and you consent to their jurisdiction.

12. Changes and termination

We may update these Terms by posting a new version with a new effective date. We may suspend access for anyone who violates them. If any provision is unenforceable, the rest remain in effect.
